1. I am an enrolled member of the Seminole Nation of Oklahoma, a federally recognized tribal government --- roll number 442-44-6967. I was born on September 19, 1948, and I reside at 97 Bast 149th St., Glenpool, Oklahoma 74033, in a Muskogee Indian Community.

2. My background is as Chairman o5 the Repatriation Committee of the United Indian Nations in Oklahoma, a coalition of 29 Federally recognized Indian tribes. In addition I have been nominated to represent the traditional and ceremonial interest of the diverse religious practices of Indian nations in Oklahoma (see attached resolution 1-96, entitled A Resolution Nominating Michael Haney to Serve on the Native American Graves Protection and Repatriation Act Review Committee as Provided in Public Law 101-601.)

3. I was an officer of the American Indian Religious Freedom Coalition made up of 150 federally recognized tribal governments. This group held hearings throughout the country on proposed amendments to the American Indian Religious Freedom Act of 1978, which resulted in an Executive Order #13007, entitled Indian Sacred Sites, issued on May 24, 1996.

4. I was a witness at Senate and House hearings and I helped to write the Bill which resulted in Public Law #101-601, entitled the Native American Grave Protection and Repatriation Act of 1990.

5. I am a member of the National Congress of American Indians, which is the largest and oldest national organization of duly elected officials of Federally recognized tribes. I presently serve on their Repatriation Commission as a field representative. That entails the duty to identify, locate and protect Native American sacred sites.

6. In this capacity I have within the past week visited the Mendota Mdewakanton Dakota village sites in the vicinity of Fort Shelling and in the area contemplated for the reroute of highway 55, including historical and prehistoric locations. I found there evidence of burial or sacred sites, continuing occupation sites, and cultural affiliated and historically significant villages of the Mendota Mdewakanton Dakota people. It is my opinion that these are sacred sites, as defined by Executive Order #13007, the Native American Grave Protection and Repatriation Act, and the 'National Historic Preservation Act, entitling them to all the protections, privileges and access afforded by the Federal laws.

7. It is my understanding that because United States Department of Transportation, Federal Highway Administration, monies are involved in financing the reroute of Highway 55 and construction of the mass transit rail system, that all Federal grave protection and applicable environmental protection laws should be followed.
